In accordance with S.B. 89 as approved by the 76th Texas Legislature in 1999, each municipality is required to adopt an annexation plan on or before December 31, 1999.
The City of Nederland has adopted an annexation plan inclusive of the following provisions:
- The annexation plan is prepared in accordance with Local Government Code Section 43.052.
- The City does not propose to annex any area, that is not exempted by State law from the requirement to be included in an annexation plan, within three (3) years of the effective date of the annexation plan.
- Property exempted from the requirement to be included on the annexation plan by Local Government Code Section 43.052(h) may be annexed by the City in accordance with State law. Accordingly, nothing herein shall be deemed a limitation on the City's ability to annex such property.
- Three (3) years prior to the effective date of annexation of a non-exempt property, the annexation plan shall be amended to include such property.
- The annexation plan may be amended at any time in accordance with State law.
- The effective date of the annexation plan shall be December 31, 1999.
