NEDERLAND CITY COUNCIL AGENDA

NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, June 28, 2004, 6:00 p.m., at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551.

  1. CALL THE MEETING TO ORDER
     
  2. APPROVE THE MINUTES OF PREVIOUS MEETING
     
  3. REQUEST

    Consider a request from Harry Wiltz for the City to pay for the costs associated with street lights located on Pirate's Cove which is a private street.

  4. PUBLIC HEARING

    Conduct a Public Hearing for the purpose of receiving comments regarding rehabilitation or condemnation and demolition of abandoned and dilapidated structures at the following addresses:

    2803 Avenue H, Sp. 5
    702 S. 9th Street
    2803 Avenue H, Sp. 8
    421 S. Hwy. 69

     
  5. ABANDONED AND DILAPIDATED STRUCTURES
     
    1. Consider action regarding the rehabilitation or condemnation and demolition of an abandoned and dilapidated structure at 2803 Avenue H, Sp. 5.
       
    2. Consider action regarding the rehabilitation or condemnation and demolition of an abandoned and dilapidated structure at 2803 Avenue H, Sp. 8.
       
    3. Consider action regarding the rehabilitation or condemnation and demolition of an abandoned and dilapidated structure at 702 S. 9th Street.
       
    4. Consider action regarding the rehabilitation or condemnation and demolition of an abandoned and dilapidated structure at 421 S. Hwy. 69.
       
  6. GRANT

    Consider action authorizing the submission of a grant application to the South East Texas Regional Planning Commission for a Solid Waste project.

  7. ORDINANCE

    Consider action approving Ordinance No. 2004-04, amending the 2003-04 budget.

  8. PAYMENTS
     
    1. Consider approval of a payment to Brystar Contracting, Inc. in the amount of $122,694.95, S. 5th Street trunk line replacement.
       
    2. Consider approval of a payment to Brystar Contracting, Inc. in the amount of $39,557.62, S. 5th Street trunk line replacement, partial release of retainage.
       
  9. APPOINTMENTS
     
    1. Consider approval of an appointment of an alternate representative to the South East Texas Regional Planning Commission Executive Committee.
       
    2. Consider approval of an appointment of a Lay Representative and an alternate to the Houston Area Library System (HALS).
       
    3. Consider approval of an appointment to the Firefighters' Civil Service Commission for a three-year term.
       
    4. Consider approval of appointments to the Planning and Zoning Commission.
       
    5. Consider approval of appointments to the Zoning Board of Appeals/Trailer Park Board of Appeals.
       
    6. Consider approval of appointments to Construction Board of Appeals.
       
  10. EXECUTIVE SESSION (No Public Discussion on These Items)

    The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law.

    Discuss personnel appointments: City Clerk, Director of Finance/Assistant City Manager, Fire Chief/Fire Marshal, Police Chief, City Judge, City Attorney, Emergency Management Coordinator, and Assistant Emergency Management Coordinator.
     
    Real Property - Texas Government Code, Chapter 551.072

    Discuss acquisition, exchange, sale, and/or release of property.
     
    Litigation - Texas Government Code, Chapter 551.071

    Discuss pending and threatened litigation:
    1. City of Nederland v. Entergy Gulf States, Entergy, Inc. and Entergy Services, Inc.
    2. Appeal of Texas Gas Service Company from the ratesetting actions of the Cities of Nederland, Port Neches, and Groves
       
    Consultation with City Attorney - Texas Government Code, Chapter 551.071
     
  11. RECONVENE

    Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session.

  12. APPOINTMENTS

    Consider action authorizing the appointment of a City Clerk, Director of Finance/Assistant City Manager, Fire Chief/Fire Marshal, Police Chief, City Judge, City Attorney, Emergency Management Coordinator, and Assistant Emergency Management Coordinator.

  13. COMMUNICATION

    Receive comments from Mayor, City Council, and City Manager.
