PLANNING AND ZONING COMMISSION
MINUTES

5:00 p.m. November 27, 2007
  1. MEETING

    The meeting was held November 27, 2007 at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order at 5:00 p.m. by Chairman C.J. Schexnaider.

    MEMBERS PRESENT: C.J. Schexnaider, Homer Nagel, Mark Griffin and Mark Byars

    MEMBERS ABSENT: Jack Porter

    CITY STAFF PRESENT: Rod Hatch, Chief Building Official, and Beth Merren, Inspections Department Secretary

    OTHERS PRESENT: Rickie and Virgie Salenga, Randall and Jody Griffith, and Robert Sawyer

  2. APPROVAL OF MINUTES

    The minutes of the August 14, 2007 meeting were approved as written.

  3. PUBLIC HEARING

    The regular meeting was recessed and a Public Hearing was called at 5:01 p.m. by Chairman C.J. Schexnaider, for the purpose of receiving questions and/or comments regarding the rezoning of the property located at 928 22nd Street, described as the NW 1/2 of Lot 3, Block 2, Cottage Groves Addition from Single Family Zoning to Neighborhood Retail Zoning.

    Rickie Salenga stated that he wanted the rezone in order to conform with the zoning classification of 920 N. 22nd Street and to meet the demands for additional housing.

    Randall Griffith, owner of the adjoining property located at 1008 22nd Street, requested that the current zoning classification remain Single Family. He presented a petition signed by nine (9) property owners who disapproved of the rezoning request.

    Robert Sawyer, Councilman Ward 1, stated that he disapproved of the request because he considered it to be spot zoning which is illegal.

    Chairman C.J. Schexnaider and Board Members Mark Griffin and Mark Byars disapproved.

  4. RECONVENE

    There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 5:06 p.m. by Chairman C.J. Schexnaider. A motion was made by Mark Griffin and seconded by Mark Byars to recommend to City Council to deny the rezoning of this property from Single Family to Neighborhood Retail. C.J. Schexnaider, Mark Griffin and Mark Byars voted against with Homer Nagel abstaining.

  5. COMMUNICATIONS

    There will be a Joint Public Hearing with the Planning and Zoning Commission and the Nederland City Council on December 17, 2007 at 6:00 p.m.

  6. ADJOURN

    There being no other business a motion was made by Homer Nagel and seconded by Mark Byars to adjourn the meeting at 5:10 p.m. All voted aye.
