NEDERLAND CITY COUNCIL AGENDA

NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, August 28, 2006, 6:00 p.m., at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551.

  5. EXTRATERRITORIAL JURISDICTION

    Consider action approving an Amendment to the extraterritorial jurisdiction Apportionment Agreement between the Cities of Nederland, Port Arthur, and Beaumont dated July 20, 1965.

  6. HURRICANE ITEMS
     
    1. Consider action approving an amendment to Ordinance No. 2000-17, waiving the $75.00 administrative fee associated with the Trailer Park Board of Appeals for Hurricane Rita related variance requests.
       
    2. Consider action approving an amendment to Ordinance No. 259, allowing the Trailer Park Board of Appeals to grant Hurricane Rita related variances for a period not to exceed one (1) year.
       
  7. CONTRACTS/AGREEMENTS
     
    1. Consider action approving an Interlocal Agreement with Tarrant County, cooperative purchasing program.
       
    2. Consider action approving a Collective Bargaining Agreement with the International Association of Firefighters Local 3339.
       
  8. PAYMENTS
     
    1. Consider action approving a payment to Brystar Contracting, Inc. in the amount of $22,848.93, Wastewater Collection System Rehabilitation FY2005.
       
    2. Consider action approving a payment to The LaBiche Architectural Group, Inc. in the amount of $2,389.23, Hurricane Rita restoration of City buildings.
       
    3. Consider action approving a payment to Carroll & Blackman, Inc. in the amount of $2,220.00, Sanitary Sewer Relocation and Sanitary Sewer Replacement.
       
  9. EXECUTIVE SESSION (No Public Discussion on These Items)

    The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law.

    Discuss acquisition, exchange, sale, and/or release of property.
     
    Litigation - Texas Government Code, Chapter 551.071

    Discuss pending and threatened litigation:
     
    1. City of Nederland v. Entergy Gulf States, Entergy, Inc. and Entergy Services, Inc.
    2. Consider potential litigation against Galveston Wireless, L.L.C.
       
    Consultation with City Attorney - Texas Government Code, Chapter 551.071
     
  10. RECONVENE

    Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session.

  11. COMMUNICATION

    Receive comments from Mayor, City Council, and City Manager.

  12. ADJOURN
