CITY OF NEDERLAND
ZONING BOARD OF APPEALS MINUTES

5:30 p.m. March 9, 2004

The meeting was held March 9, 2004 at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas and was called to order at 5:30 p.m., by Chairman Guy Barlow.

MEMBERS PRESENT: Guy Barlow, Barney Green, Bill Cummins, Kenneth Whigham and Mickey Fenn
CITY STAFF PRESENT: Rod Hatch, Building Official and Debby Griffin, Inspections Department Secretary
OTHERS PRESENT: Connie Megas, Ed Hughes, Bobby Wohner, David Ray and Loye Kemp

MINUTES
The minutes of the January 27, 2004 meeting were approved as written. All voted aye.

VARIANCES

  1. Connie Megas, owner of the property located at 2828 Highway 365, described as Lot 9, Block 4, Tract 7, Hillcrest Second Acres, requested a variance to place a 352 square foot building 3' off of the east property line and approximately 6" off of the front property line in lieu of the 30' front building setback requirement. After a full discussion a motion was made by Bill Cummins and seconded by Kenneth Whigham to approve the variance. All voted aye.
     
  2. Ed Hughes, owner of the property located at 2750 Nederland Avenue, described as Block A, Tract 2, Youmans 2nd Addition, requested a variance to encroach 20' into the 30' building setback line with an addition to the front of the building. After a full discussion a motion was made by Barney Green and seconded by Mickey Fenn to approve the variance. All voted aye.
     
  3. David K. Ray, owner of the property located at 1824 Gary Avenue, described as Lot 9, Block 1, West Side Addition, requested a variance to encroach 8' into the 20' rear yard requirement. After a full discussion a motion was made by Barney Green and seconded by Bill Cummins to approve the variance. All voted aye.
     
  4. Loye Kemp, owner of the property located at 307 2nd Street, described as Lot 10 & Adj. 1/2 of Lot 11, Block 4, John Staffen Addition, requested a variance to encroach 11.4' into the 20' rear yard with a new house. After a full discussion a motion was made by Bill Cummins and seconded by Kenneth Whigham to approve the variance. All voted aye.

There being no other business a motion was made by Bill Cummins and seconded by Kenneth Whigham to adjourn the meeting at 5:40 p.m. All voted aye.
