NEDERLAND CITY COUNCIL AGENDA

NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, March 8, 2004, 3:00 p.m., at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551.

  1. CALL THE MEETING TO ORDER
     
  2. APPROVE THE MINUTES OF PREVIOUS MEETING
     
  3. REQUEST

    Consider a request from Sunoco Partners Marketing & Terminals L.P. for a tax abatement.

  4. COMMENTS

    Receive comments from Kirk Gillespie regarding the zoning of the property at 504 S. 28th Street.

  5. WAIVER

    Consider action authorizing the Jefferson County Mosquito Control District to fly at low altitudes as required for the application of pesticides for the control of mosquitoes within the City limits of Nederland.

  6. CONTRACTS/AGREEMENTS
     
    1. Consider action approving an Interlocal Agreement with Jefferson County and Hardin County for the Jefferson County Narcotics Task Force.
       
    2. Consider action appointing an auditing firm to perform the City's audit for FY 2003-04.
       
  7. ORDINANCE

    Consider action approving an Amendment to Ordinance No. 107, regulation of traffic in school zones.

  8. BIDS/PROPOSALS
     
    1. Consider action authorizing the award of bid for a Breathing Air Compressor System and Self Contained Breathing Apparatus Filling Station for the Fire Department.
       
    2. Consider action authorizing the award of a proposal for Fire Station repairs.
       
    3. Consider action approving the purchase of portable radios for the Fire Department.
       
  9. HEALTH INSURANCE
     
    1. Consider action authorizing the advertisement of bids for employee group health benefits.
       
    2. Consider action appointing Terry Hale of Hale Benefits Analysis, Ltd. (HBAS) as the agent of record for the purpose of managing the competitive bid process for employee group health benefits.
       
  10. GRANT

    Consider action authorizing the submission of an Emissions Reduction Incentive Grant application to the Texas Commission on Environmental Quality (TCEQ).

  11. SURPLUS

    Consider action declaring certain City property as surplus and authorizing its disposal.

  12. PAYMENTS
     
    1. Consider action authorizing payment to d.p. Consulting Engineers, Inc. in the amount of $4,750.00, Allan Meadows drainage study.
       
    2. Consider action authorizing payment to d.p. Consulting Engineers, Inc. in the amount of $1,432.00, Boston Avenue pavement rehabilitation project.
       
    3. Consider action authorizing payment to d.p. Consulting Engineers, Inc. in the amount of $1,523.00, upper Main C drainage improvements.
       
    4. Consider action authorizing payment to Excavators & Constructors, Inc. in the amount of $100,309.29, drainage improvements, Area 3.
       
    5. Consider action authorizing payment of the bills for the month of February.
       
  13. EXECUTIVE SESSION (No Public Discussion on These Items)

    The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law.

    Discuss pending and threatened litigation:
    1. City of Nederland v. Entergy Gulf States, Entergy, Inc. and Entergy Services, Inc.
    2. Litigation against KSA Engineers, Inc. and ALLCO, Inc. regarding water treatment plant
    3. Appeal of Texas Gas Service Company from the ratesetting actions of the Cities of Nederland, Port Neches, and Groves
       
    Consultation with City Attorney - Texas Government Code, Chapter 551.071
     
  14. RECONVENE

    Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session.

  15. COMMUNICATION

    Receive comments from Mayor, City Council, and City Manager.
