CITY OF NEDERLAND
PLANNING AND ZONING COMMISSION
PUBLIC HEARING MINUTES

5:00 p.m. February 10, 2004

The meeting was called to order at 5:00 p.m. by Chairman C. J. Schexnaider at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas.

MEMBERS PRESENT: C. J. Schexnaider, Kenneth Mitchell, Tim Sheffield, Mark Griffin and Jack Porter
CITY STAFF PRESENT: Rod Hatch, Building Official and Debby Griffin, Inspections Department Secretary
OTHERS PRESENT: Kirk Gillespie, Craig McGee and several citizens

MINUTES
The minutes of the September 3, 2003 meeting were approved as written. All voted aye.

PUBLIC HEARING
The regular meeting was recessed and a Public Hearing was called to order at 5:03 p.m. by Chairman C. J. Schexnaider for the purpose of receiving questions and/or comments regarding the rezoning of the property located at 504 S 28th Street, described as Lot 33, Block 1, of the Hillcrest Second Addition. This property is currently zoned R-2 Multi-Family and Kirk Gillespie is requesting to change the zoning to R-3 Apartments.

Don Harper, 508 S 27th Street; James Collins, 520 S 27th Street; Shelly Breaux, 2815 Avenue D and James Stansbury, 2816 Avenue D stated that they were against the property being rezoned. One concern was that Mr. Gillespie owns the duplex at the front of this property and does not take care of it so how would he take care of additional units. Another concern was about the street being narrow and that there is not enough room for additional traffic.

Kirk Gillespie stated that he is in the process of selling this property to Craig McGee who is interested in building five sets of duplexes. He states that if the property is not rezoned it will be landlocked and nothing will be done with it.

RECONVENE
There being no other questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 6:05 p.m. by Chairman C. J. Schexnaider. A motion was made by Jack Porter and seconded by Mark Griffin to recommend to City Council to approve the rezoning of this property from R-2 Multi-Family to R-3 Apartments. All voted aye.

COMMUNICATION
There will be a Joint Public Hearing with the Planning and Zoning Commission and the Nederland City Council on February 23, 2004 at 5:30 p.m.

ADJOURN
There being no other business a motion was made by Jack Porter and seconded by Mark Griffin to adjourn the meeting at 6:10 p.m. All voted aye.
