NEDERLAND CITY COUNCIL AGENDA

NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, November 14, 2005, 3:00 p.m., at the Nederland City Office Building, 1400 Boston Avenue, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551.

  2. APPROVE THE MINUTES OF PREVIOUS MEETING
     
  3. PROCLAMATION

    Consider action proclaiming November 14, 2005 as "NHS Varsity Volleyball Day" in Nederland, Texas.

  4. PRESENTATION

    Presentation by the Corps of Engineers regarding the status of debris removal.

  5. REQUESTS

    1. Consider action regarding a request from Louise Grossman, 315 4th Street, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    2. Consider action regarding a request from John Wise, 203 15th Street, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    3. Consider action regarding a request from Michael W. Johnson, 316 15th Street, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    4. Consider action regarding a request from Melody Gilbert, 2704 Avenue M, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    5. Consider action regarding a request from Jeffrey Campbell, 720 15th St, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    6. Consider action regarding a request from A. O. Zarate, 3503 Avenue D, for an exception to the City of Nederland water billing policy due to circumstances associated with Hurricane Rita.
       
    7. Consider action regarding a request from Gregory and Patricia Martin, 704 Chicago Avenue, to abandon 105' of the right-of-way at the dead end of 7th Street.
       
    8. Consider action regarding a request from Steve Hogg, 1419 Avenue E, concerning the condition of the property at 1423 Avenue E.
       
    9. Consider action regarding a request from Shirley LeDoux, 1207 South 14th Street, pertaining to the enactment of an ordinance governing registered sex offenders.
       
  6. PERMITS

    Consider action authorizing a permit for StatCare EMS.

  7. RESOLUTIONS

    1. Consider action approving Resolution No. 2005-19, casting votes for the Jefferson County Appraisal District Board of Directors.
       
    2. Consider action approving Resolution No. 2005-20, approving the 2005 tax roll as certified by the Jefferson County Tax Office.
       
  8. WAIVERS

    1. Consider action authorizing the waiver of penalty and interest on tax Account No. 862183-004000.
       
    2. Consider action authorizing the waiver of penalty and interest on tax Account No. 862183-004100.
       
  9. BIDS/PROPOSALS

    1. Consider action authorizing the advertisement of bids for roof and structural repairs to City of Nederland buildings as a result of Hurricane Rita.
       
    2. Consider action authorizing the advertisement of bids for interior repairs to City of Nederland buildings as a result of Hurricane Rita.
       
  10. HURRICANE RITA DEBRIS REMOVAL ASSISTANCE

    Consider action authorizing that the City of Nederland request that Direct Federal Assistance for Hurricane Rita debris removal be assigned to the U.S. Army Corps of Engineers.

  11. PAYMENTS

    1. Consider action approving a payment to Schaumburg & Polk, Inc. in the amount of $120.00, Beauxart Garden Road improvements.
       
    2. Consider action approving payment of the bills for the month of October.
       
  12. EXECUTIVE SESSION (No Public Discussion on These Items)

    The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law.

    Discuss pending and threatened litigation:

    2. Appeal of Texas Gas Service Company from the ratesetting actions of the Cities of Nederland, Port Neches, and Groves
    3. Appeal of CenterPoint Energy Entex from ratesetting actions of the City of Nederland
       
    Consultation with City Attorney - Texas Government Code, Chapter 551.071
     
  13. RECONVENE

    Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session.

  14. COMMUNICATION

    Receive comments from Mayor, City Council, and City Manager.

  15. ADJOURN
