CITY OF NEDERLAND
ZONING BOARD OF APPEALS MINUTES

The meeting was held March 22, 2005 at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta, Nederland, Texas and was called to order at 5:00 p.m. by Chairman Guy Barlow.

MEMBERS PRESENT: Guy Barlow, Barney Green, Mickey Fenn and Kenneth Whigham
MEMBERS ABSENT: Bill Cummins
CITY STAFF PRESENT: Rod Hatch, Building Official and Beth Merren, Inspections Department Secretary
OTHERS PRESENT: Tim Marroquin, Josh Seymour, and Reed Richard

MINUTES

The minutes of the March 8, 2005 meeting were not approved as written. Barney Green advised the Board that he did not make the motion to approve a variance to build 25" from the rear property line as written in the minutes. Motion made by Guy Barlow and seconded by Barney Green to notify Mr. Charles Poskey that due to the error in the March 8, 2005 minutes, the Board's ruling of March 8, 2005 was nullified and Mr. Poskey could resubmit his request for the variance. MOTION CARRIED. MINUTES APPROVED AS CORRECTED.
Ayes: Guy Barlow, Barney Green, Mickey Fenn, and Kenneth Whigham.
Noes: None.

VARIANCE
 

  1. Mr. Tim Marroquin, representative of Nederland Avenue Apartments, Ltd., owner of the property located at 2900 Nederland Avenue, described as 5.3 acres out of Lot A, Youmans 2 Addition requested a variance on the following:
     
    1. A variance for the building height of two of the apartment buildings to exceed the building height requirement by 7'. Motion made by Barney Green and seconded by Mickey Fenn to approve the variance. MOTION CARRIED. VARIANCE GRANTED.
      Ayes: Guy Barlow, Barney Green, Mickey Fenn, and Kenneth Whigham.
      Noes: None.
       
    2. A variance for the smallest one-bedroom apartment (573 square feet) to be 77 square feet smaller than the ordinance requirement of 650 square feet. Motion was made by Mickey Fenn and seconded by Barney Green to approve the variance. MOTION CARRIED. VARIANCE GRANTED.
      Ayes: Guy Barlow, Barney Green, and Mickey Fenn.
      Noes: None.
      Abstained: Kenneth Whigham.
       
  2. Mr. Josh Seymour, owner of property located at 1904 Franklin Avenue, described as Lots 11 and 12 of the West Side Addition, requested approval to encroach 16' into the 20' setback for a 6' privacy fence. Motion made by Barney Green and seconded by Mickey Fenn to deny the variance. MOTION CARRIED. VARIANCE DENIED.
    Ayes: Guy Barlow, Barney Green, and Mickey Fenn.
    Noes: None.
    Abstained: Kenneth Whigham.

COMMUNICATIONS

The Board was advised that Mr. Erik Shaw, owner of property located at 402 Tulip Lane, described as Lot 7, Holland Homes Subdivision informed Mr. Rod Hatch, Chief Building Official, that adjustments to his house plans had been made and it would no longer be necessary to request a variance.

ADJOURN

There being no other business a motion was made by Barney Green and seconded by Kenneth Whigham to adjourn the meeting at 5:40 p.m. MOTION CARRIED.

Noes: None.
