CITY OF NEDERLAND
ZONING BOARD OF APPEALS MINUTES

5:00 p.m. March 8, 2005

The meeting was held March 8, 2005 at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta, Nederland, Texas and was called to order at 5:00 p.m. by Chairman Guy Barlow.

MEMBERS PRESENT: Guy Barlow, Barney Green, Mickey Fenn and Kenneth Whigham
MEMBERS ABSENT: Bill Cummins
CITY STAFF PRESENT: Rod Hatch, Building Official and Beth Merren, Inspections Department Secretary
OTHERS PRESENT: Mr. and Mrs. Doyle Osborne, Mr. and Mrs. Charles Poskey, and Mrs. Kerri Martin

MINUTES

A motion was made by Barney Green and seconded by Mickey Fenn to approve the minutes of the February 8, 2005 meeting. All voted aye.

VARIANCE
 

  1. Mr. and Mrs. Doyle Osborne, owners of the property located at 1124 Robin's Circle, described as Lot 8, Robin's Cove Addition, requested approval on a variance on a 9' encroachment into the 20' rear yard requirement. After a full discussion a motion was made by Mickey Fenn and seconded by Kenneth Whigham to approve the variance. All voted aye.
     
  2. Mr. Erik Shaw, owner of the property located at 402 Tulip Lane, Holland Homes Addition, requested approval on a variance for a 5' encroachment into the 5' side drainage easement to construct a driveway. After a full discussion regarding the possibility that the excavated material would settle and the driveway would sink and/or crack, it was recommended that the excavated material be replaced with stabilized sand. A motion was made by Kenneth Whigham and seconded by Mickey Fenn to table the request until an alternative solution is determined. All voted aye.
     
  3. Mr. and Mrs. Charles Poskey, owners of the property located 1411 27th Street, described as Lot 4, Part of Tract 3, Block 2, of the Moak Addition, requested approval on a variance to build a 16' x 16' building approximately 25" from the side and rear property lines. After a full discussion, a motion was made by Barney Green and seconded by Guy Barlow to deny the request for a variance to build 25" from the side property line. All voted aye.

    A motion was made by Barney Green and seconded by Guy Barlow to approve a variance to build 25" from the rear property line. Kenneth Whigham and Mickey Fenn voted to deny the variance with Barney Green and Guy Barlow voting to approve. Motion and variance denied.

COMMUNICATIONS

Guy Barlow read Mr. Hatch's letter to Reed Richard confirming his compliance with the 5' side yard setback as directed by the Zoning Board of Appeals.

ADJOURN

There being no other business a motion was made by Mickey Fenn and seconded by Kenneth Whigham to adjourn the meeting at 5:45 p.m. All voted aye.
